  1. INTRODUCTION AND SCOPE

National e-Governance Division (NeGD), Government of India, is committed to protecting the privacy and personal data of all users in accordance with applicable data privacy laws of India, Information Technology Act, 2000, and other relevant Indian legislation. This Privacy Policy applies to all personal data collected, processed, and stored through NeGD website (negd.gov.in), mobile applications, digital services, integrated Digital India ecosystem platforms, and government service portals managed by NeGD. This Privacy Policy should be read in conjunction with our Terms and Conditions for comprehensive understanding of website usage terms.

  1. DATA COLLECTION AND PROCESSING

NeGD collects IP addresses during website visits. Personal Information collection, use and disclosure require express consent unless other legal grounds exist as specified in this Privacy Policy. By using the Platform or providing Personal Information, you consent to our use, collection, retention, transfer and disclosure per this Privacy Policy. Upon data protection law changes in India, you consent to continued use and disclosure to the fullest extent permitted, with additional consents sought as required under amended laws. Personal data is processed for providing Government services, meeting statutory obligations, statistical analysis for governance improvements, improving website functionality, protecting systems from security threats, and sending service notifications. Data processing occurs under express consent from data subjects; legal obligations under Indian laws; official Governmental functions and public interest activities, and; protection of life, health, or safety. NeGD website contains freely accessible information that any visitor may view. However, NeGD retains copyright ownership over the content of its website. Access to NeGD’s website is restricted to users within India, and users outside India may be restricted or unable to access the site.

This website secures personal information from unauthorised access through SSL encryption, secure servers, multi-factor authentication, firewalls, and regular monitoring. Personal data is stored in regulated environments protected from illicit access. NeGD does not retain any personal data other than IP address of the user and under applicable privacy laws keeps data only as long as necessary to provide services or as required under any law. NeGD keeps anonymised data for research and statistical purposes for a longer period of time. Subject to applicable law, NeGD may securely dispose of Personal Data without prior notice to the data principal. Data breaches trigger immediate assessment, authority notification within 72 hours, user notification when required, and thorough investigation.

Users are prohibited from attempting unauthorized access to personal data or systems, introducing malicious software or harmful code, interfering with data processing operations, and attempting to decrypt encrypted data or bypass authentication. Security violations result in criminal prosecution under applicable laws, civil liability for damages, immediate access suspension and account termination, and full law enforcement cooperation including user identity disclosure.

 

  1. CONFIDENTIALITY AND ACCESS RESTRICTIONS

All personal data is treated as confidential with access restricted to authorized personnel only, staff and contractors bound by strict confidentiality clauses, periodic access permission reviews and updates, and comprehensive logging of all data access activities. Government agency access to personal data is permitted only when required by law or court order, necessary for national security or public safety, with appropriate legal authorization and oversight, and subject to proportionality and necessity principles. NeGD agrees to keep the data and information (the “Confidential Information”) discreet and maintains strict confidentiality protocols for all user data and governmental information.

The User agrees to hold harmless, defend and indemnify NeGD, its affiliates, officers, employees, agents, and third-party service vendors in respect of any losses, claims, damages and expenses arising from the User’s use of the services, disclosure of information to third parties, and access of third-party websites and resources.

The User agrees that grievances will be addressed and resolved, in compliance with applicable rules/guidelines.

NeGD, reserves the right to modify this Policy periodically to comply with legal changes, align with Digital India policies, improve functionality, and address security concerns.
